Terms of Service

1. Agreement to Terms
By accessing or using the services provided by RielArt ("we," "our," or "us"), including our website at rielart.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services Description
RielArt provides digital services including but not limited to:
- Brand identity design (logos, color systems, brand guidelines)
- Web design and development (custom Webflow sites, responsive design)
- Paid advertising management (Meta, LinkedIn campaigns)
- Growth support (optimization, A/B testing, analytics)
- AI integration services (workflow automation, chatbots, smart analytics)
- AI content systems (automated content generation, personalization)
Specific deliverables, timelines, and pricing will be outlined in individual service agreements or statements of work.
3. Intellectual Property
Client Content: You retain all ownership rights to content, materials, and assets you provide to us for use in your projects.
Our Work: Upon full payment, you will receive ownership rights to the final deliverables created specifically for your project. We retain the right to use non-confidential portions of the work for our portfolio, case studies, and marketing materials unless otherwise agreed in writing.
Pre-existing Materials: We retain all rights to our pre-existing materials, tools, templates, and methodologies used in creating your deliverables.
4. Payment Terms
Payment terms will be specified in your individual service agreement. Unless otherwise stated:
- A deposit may be required before work begins
- Payment is due within 14 days of invoice date
- Late payments may incur a service charge of 1.5% per month
- Work may be paused for accounts with outstanding balances exceeding 30 days
5. Project Timeline
We will make every effort to meet agreed-upon deadlines. However, project timelines may be affected by client feedback delays, scope changes, or circumstances beyond our control. We will communicate any anticipated delays as soon as possible.
6. Revisions and Scope Changes
Each project includes a specified number of revision rounds as outlined in your service agreement. Additional revisions or scope changes may incur additional fees. We will always discuss and agree on any additional costs before proceeding.
7. Termination
Either party may terminate the service agreement with written notice:
- By Client: You may terminate at any time. You will be billed for work completed up to the termination date.
- By RielArt: We reserve the right to terminate if payment is not received according to agreed terms or if the working relationship becomes untenable.
8. Limitation of Liability
To the maximum extent permitted by law, RielArt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of our services.
9. Confidentiality
We respect the confidentiality of your business information. We will not disclose any proprietary or confidential information to third parties without your consent, except as required by law.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right to modify these terms at any time. We will notify clients of significant changes. Continued use of our services after changes constitutes acceptance of the updated terms.
